Acceptance of these Terms
Fantasi ("Fantasi," "we," "us," or "our") is currently operated as an individually-owned, unincorporated business under the working name "Fantasi." These Terms of Service ("Terms") are a binding agreement between you and Fantasi governing your access to and use of the Fantasi website, mobile-optimized web app, and related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

Eligibility
You must be at least 18 years old to create an account or use the Service. We verify date of birth at registration and reject applications from anyone who does not meet this requirement; misrepresenting your age is a violation of these Terms and grounds for immediate termination.
- You may maintain only one account, under your own identity.
- The information you provide at registration and in your profile must be accurate and kept up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- The Service is intended for consenting adults exploring adult social and romantic connections. By using it, you represent that all interactions you pursue through it are, and will remain, lawful and consensual.

The Service
Fantasi is a members-only social platform. New applications are reviewed before an account is activated; approval is at our discretion and is not guaranteed. We do not guarantee that you will be matched with, meet, or successfully communicate with any other member, and we make no representation about the outcome of any connection made through the Service.
Some features (currently: a photo gallery with photo-approval privacy controls, incognito browsing, and geofenced discovery privacy) are limited to specific membership tiers. Membership tiers are currently granted by administrative review rather than automated payment — see Section 6.

Conduct & Prohibited Uses
You agree not to, and not to attempt to:
- Use the Service if you are under 18, or to facilitate, depict, or solicit sexual content involving anyone under 18. We report any such activity to the National Center for Missing & Exploited Children and/or law enforcement as required by law.
- Post, share, or transmit content depicting or soliciting non-consensual acts, or use the Service to harass, threaten, stalk, coerce, or intimidate another person.
- Solicit or offer commercial sexual services where doing so is illegal in the applicable jurisdiction.
- Impersonate any person, or misrepresent your identity, age, or affiliation.
- Upload photos or content that are not your own, or that you do not have the rights to share.
- Use the Service to spam, advertise unrelated goods or services, or run automated scraping, bots, or unauthorized data collection against the Service.
- Attempt to circumvent a block placed by another member, or contact a member who has asked not to be contacted.
- Interfere with, disable, or attempt to bypass the Service's security, rate limiting, or access controls.
We rely on member reports and administrative review to enforce this section — see Section 8 for the current limits of that review.

Your Content
You retain ownership of the photos, profile information, messages, and forum posts you submit to the Service ("Your Content"). By posting Your Content, you grant Fantasi a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you and, where applicable, the other members you choose to share it with (e.g. approved photo access, forum posts visible to other members).
We may remove Your Content, or restrict your account, if we determine in good faith that it violates Section 4 or applicable law. We do not pre-screen content before it is posted; moderation is primarily reactive, driven by member reports reviewed by an administrator.

Membership Tiers & Payments
Fantasi currently offers tiered membership (Free, Silver, Gold, Black) with additional features at higher tiers. As of the date above, tier upgrades are requested in-app and granted manually by an administrator — Fantasi does not currently process payments or store payment card information, and no fee is charged for any tier.
If paid membership is introduced in the future: any payment will be processed by a third-party payment processor, who will handle and store your payment details subject to their own terms — Fantasi will not directly receive or store full card numbers. We will update these Terms with pricing, billing cycle, refund, and cancellation terms before any charge is introduced, and will require your acceptance of the updated Terms before charging you.

Privacy
Our Privacy Policy describes what information we collect, how we use it, who we share it with, and the choices and rights available to you, including how to access, correct, restrict, object to, export, or delete your data through the in-app Privacy & Data page. It is part of these Terms.

Safety & No Guarantee of Verification
Your safety matters to us, but you should understand the actual limits of what we currently verify:
- We verify the date of birth you provide at registration and require it to indicate you are 18 or older.
- We require a government-issued ID (photo or PDF) at registration, which a human administrator reviews before your application is approved. This confirms the ID you provided is consistent with the age and name on your application — it is not a criminal background check, and we do not currently perform one.
- Phone number verification, where completed, confirms you control the phone number provided — it does not verify your identity.
- Badges, labels, or statements elsewhere on the Service describing a member as "verified" reflect the specific check actually performed (ID review at registration, and/or a verified phone number) and should not be read as a representation that the member's ongoing intentions or statements have been independently confirmed.
- We investigate reports of misconduct through an administrative review process, but we do not provide 24/7 staffed support or a guaranteed response time.
You are solely responsible for exercising your own judgment and discretion in any interaction with another member, including whether, when, and how to meet in person. We strongly encourage you to take independent precautions — informing a trusted contact of your plans, meeting in public initially, and verifying identity to your own satisfaction — before meeting anyone from the Service.

Suspension & Termination
You may delete your account at any time by submitting a deletion request through the in-app Privacy & Data page. We may suspend or terminate your account, with or without notice, if we determine you have violated these Terms, applicable law, or if we discontinue the Service. Upon termination, your right to use the Service ends immediately; Sections 5, 8, 11, 12, and 13 survive termination.

Intellectual Property
The Fantasi name, logo, and the Service's design, software, and branding are the property of Fantasi and may not be copied, reproduced, or used without our prior written permission. Nothing in these Terms transfers any of our intellectual property to you.

Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY OTHER MEMBER'S CONDUCT, STATEMENTS, OR IDENTITY WILL MEET YOUR EXPECTATIONS OR BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTASI WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH ANOTHER MEMBER, WHETHER ONLINE OR IN PERSON. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so some of the above may not apply to you.

Indemnification
You agree to indemnify and hold Fantasi harmless from any claim, loss, or demand, including reasonable attorneys' fees, arising from your use of the Service, Your Content, your violation of these Terms, or your interaction with another member.

Governing Law & Disputes
These Terms are governed by the laws of the State of Louisiana, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Louisiana, and you consent to personal jurisdiction there.

Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date above and, where required by law, provide additional notice. Continuing to use the Service after a change takes effect constitutes acceptance of the updated Terms.
